Get Visualive Ltd. acknowledges and unilaterally commits to comply with the content of these guidelines and to ensure that all data processing related to its activities complies with the requirements set forth in this policy and the applicable laws.
I. Introduction
This information (hereinafter referred to as “Data Protection Guidelines”) pertains to the processing of voluntarily provided or legally processed personal data arising in connection with the subscription to print, audio, or digital publications issued by Get Visualive Ltd., fulfillment of ordered services, services available and downloadable via the internet, conferences, training (video or event), organization of exhibitions, other games involving rewards or prizes, as well as direct business acquisition and marketing-related contacts (eDM). These guidelines are applicable in all cases where a specific service specifically refers to the Data Protection Guidelines. For each Service, these Data Protection Guidelines (or, if applicable, the specific notice) provide information regarding the scope of personal data processed, the purpose and duration of data processing, the methods and options for rectification and deletion of data, the processors involved, and whether data is transferred to third parties. Specific notices related to individual products are only valid in conjunction with these Data Protection Guidelines.
The Data Protection Guidelines and the specific notices related to individual products form an integral part of the General Terms and Conditions and are to be interpreted and applied together.
Both the Data Protection Guidelines and the Terms of Use may be unilaterally modified, with the modified text appearing on the website. In such cases, visiting the website is considered as acceptance of the modifications. We will provide separate, individual notifications for significant changes or changes requiring consent.
By ordering or using individual services or sub-services, you as the User consent to the processing of your personal data by Get Visualive Ltd. in accordance with the provisions of the Data Protection Guidelines (customer relationship). The customer relationship involves maintaining contact details. However, eDM and marketing services are only available to users who provide separate consent at the specified location related to the product or service.
II.Principles
Get Visualive Ltd. handles personal data obtained from users, collected in accordance with these Guidelines, in compliance with the applicable data protection laws, including, in particular, Act CXII of 2011 on Informational Self-Determination and Freedom of Information, international privacy conventions, European Union legal sources (especially regarding the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and the repeal of Directive 95/46/EC, known as the General Data Protection Regulation (GDPR)).
As background legislation, the Civil Code of Hungary (Act V of 2013) and the legislation on advertising and electronic commerce are also applicable.
Get Visualive Ltd. only processes personal data of customers/users in accordance with the provisions of these Guidelines and the specific data processing notices for each product, for the period and purpose to which the consent of the customer/user has been given or as required by law. Based on secondary legal grounds, if necessary, Get Visualive Ltd. processes data based on the principle of balancing of interests, meaning only if it is absolutely necessary for the rights, legal obligations, or legitimate interests of the company.
Get Visualive Ltd. takes all necessary technical and organizational measures to ensure the security of the personal data provided or made accessible by the users throughout the entire data processing process. Information security services are provided by accredited providers.
The terms used in these Data Protection Guidelines shall be interpreted in accordance with the provisions of Act CXII of 2011 on Informational Self-Determination and Freedom of Information and the data protection dictionary of the Hungarian National Authority for Data Protection and Freedom of Information (NAIH).
III. Purpose and Legal Basis of Data Processing
The purpose of data processing is to provide the service(s) and sell the product(s), as well as to provide related information, including:
- Identification of the customer/user and differentiation from other customers/users.
- Communication and, with consent for electronic direct marketing (eDM), notification about related or new services and products.
- Testing and measuring customer satisfaction.
- Facilitating customization of the service or product.
- Sending system messages related to the service or product.
- Direct marketing and marketing communication for advertising purposes, subject to separate consent (e.g., newsletters, eDM).
- Creating contracts, determining their content, delivering ordered products, and using specific bonuses if there is a purchasing opportunity.
- Participation in events and related ancillary services.
- Membership-related services and bonus programs.
- Advertising third-party products without transferring data.
The collection and processing of personal data in exchange for certain paid services are based on legislation, including the Act CXVII of 1995, Act C of 2000, and Act XCII of 2003, which regulate tax and accounting obligations. In the absence of specific provisions, data processing is based on the voluntary consent of the user. Marketing consents are recorded separately and can be distinguished from customer status.
The user is solely responsible for the authenticity and accuracy of personal data.
The scope of personal data managed by Get Visualive Ltd. is influenced and partly determined by e-commerce, accounting, and advertising regulations, particularly Section 6 of Act XLVIII of 2008 on the fundamental requirements and certain limitations of economic advertising activities, Sections 13/A to 14/C of Act CVIII of 2001 on electronic commerce services and services related to the information society.
Some services can only be accessed through registration, which involves the collection and processing of personal data that is necessarily and individually provided during the registration process.
For certain additional services (e.g., bonuses), registration and contract formation are only possible in conjunction with subscribing to the service-related newsletter or other direct marketing and advertising communications. In other services, there may be an option to subscribe to newsletters and other advertising messages.
To facilitate user activity and maximize the opportunities provided by the services, various types of cookies (e.g., session cookies, persistent browser cookies, flash cookies, etc.) may be placed in accordance with the provisions outlined in the Specific Data Processing Notice. A cookie is a small data package that collects and stores information specified by the server.
Web Analytics
Get Visualive Ltd. informs its users that it utilizes Google Analytics and Google AdSense programs for measuring website traffic, monitoring visitor behavior, generating statistics, and evaluating the effectiveness of its advertisements.
The mentioned programs place cookies, which collect user data, on the user’s computer. By visiting Get Visualive Ltd.’s website, users authorize Get Visualive Ltd. to use Google Analytics and Google AdSense programs and consent to the monitoring and tracking of their user behavior, as well as the utilization of all services provided by these programs on behalf of Get Visualive Ltd. Additionally, users have the option to disable the recording and storage of cookies for future use, as described below.
We would like to inform our users that the settings and usage of Google Analytics and Google AdSense programs fully comply with the requirements of data protection authorities. According to Google’s information, Google Analytics primarily reports visitor interactions on the website using first-party cookies. These cookies record only non-identifiable information. Get Visualive Ltd. primarily uses the Google Analytics program for generating statistics and measuring the effectiveness of its campaigns. Through the program, Get Visualive Ltd. obtains information about the number of visitors to its websites, the time spent by visitors on the webpages, and the IP addresses of the visitors. This allows tracking whether the visitor is a new or returning visitor, as well as the visitor’s browsing path and entry points on the website.
By using the Google AdSense program, Get Visualive Ltd. collects data from the DoubleClick cookie in addition to the usual data from Google Analytics. The AdSense service is primarily used to ensure that visitors to Get Visualive Ltd.’s websites encounter advertisements from Get Visualive Ltd. on freely available Google advertising platforms. Get Visualive Ltd. utilizes the Google AdSense program for its online advertisements. The advertisements of Get Visualive Ltd. are displayed by external providers, such as Google, on various internet websites. Get Visualive Ltd. and external providers, such as Google, collectively use their own cookies (e.g., Google Analytics cookies) and third-party cookies (e.g., DoubleClick cookies) to navigate based on users’ previous visits and optimize and display advertisements. Restrictions
For individuals who have not reached the age of 16 or are otherwise legally incapacitated, consent can be given by their legal representative.
Previously deleted registrations are recorded in our system, and separate confirmation is required for re-registration.
IV. Rights and Remedies Related to Data Processing
Modification, Deletion, and Blocking of Data
The User can modify or request the correction of their data at any time.
The User, except for mandatory data processing, can delete their personal data or request the deletion or blocking of their personal data through the designated contact(s) and method(s) specified on the respective websites or services (e.g., user account, email, etc.). In certain cases, the premature deletion of personal data may be equivalent to the loss of certain entitlements (e.g., bonuses).
The personal data of customers/users will be deleted if their processing is suspected to be illegal (e.g., violation of the Competition Act or any criminal law provisions), the purpose of data processing has ceased, the legally determined storage period has expired, it has been ordered by a court or the National Authority for Data Protection and Freedom of Information, or if the data processing is incomplete or inaccurate, and this state cannot be lawfully rectified, provided that deletion is not prohibited by law. Our system does not store special data, and such data is automatically deleted.
Consent for sending commercial advertisements and direct marketing communications containing commercial offers can be revoked separately for each type of communication (e.g., newsletter, e-DM, etc.) at any time, without restrictions or justification, free of charge, at the bottom of the emails, using the same method as subscribing. Data processing related to customer relations cannot be terminated as long as legal regulations prescribe the obligation of data processing.
Request for Information
The User is entitled to request information about the personal data related to them, which is processed in connection with the specific service or product, at the email address webmaster@selvescards.com.
Upon the User’s request, Get Visualive Kft. provides information about the data processed by the User or processed by the authorized data processor, including the source of the data, the purpose and legal basis of data processing, the duration of processing, the name and address of the data processor, the activities related to data processing, the legal basis and recipients of data transfers.
Objection to the Processing of Personal Data
The User can object to the processing of their personal data:
- If the processing or transmission of personal data is necessary solely for fulfilling the legal obligations concerning Get Visualive Kft. or for asserting the legitimate interests of the data controller, data recipient, or a third party, except in the case of mandatory data processing.
- If the use or transmission of personal data occurs for the purpose of direct acquisition of customers, public opinion research, or scientific research.
- In other cases specified by law.
The User can object to the processing of their personal data:
If the data processing is prescribed by law (e.g., accounting), the data controller cannot delete the User’s data; however, they shall not transmit the personal data to the data recipient if they agree with the objection or if the court determines the validity of the objection.
Administrative Remedy
Any data subject who believes that their rights related to the processing of personal data have been violated may turn to the competent court or initiate an investigation at the National Authority for Data Protection and Freedom of Information (President: Dr. Attila Péterfalvi, 1024 Budapest, Szilágyi Erzsébet fasor 22/C, ugyfelszolgalat@naih.hu, +36-1-3911400, www.naih.hu), including the Metropolitan Court in Budapest.
V. Disclosure of Information, Data Transmission
Disclosure to the public is only done with separate consent.
Data transmission to third parties (external persons) does not occur. However, in the case of certain products, the data processing information may vary.
